Accused murderer found incompetent to stand trial

"Johnny Phillips of Bremerton was found incompetent to stand trial for murder in Kitsap County Superior Court Wednesday, June 6, according to Kitsap County Deputy Prosecutor Rebecca Jones.Phillips' case has been referred to the state Attorney General's office for civil commitment. His case here was dismissed without prejudice, Jones said. That means if Phillips ever is restored to competency he can be recharged, said Michael Sloan, brother of Debra Gordon, the victim.The case was turned over to the state, with a civil commitment hearing set for June 25 at Western State Hospital in Steilacoom. But a source at the Attorney General's office said they might seek a continuance until July 2. Phillips is charged with second degree murder for the Nov. 14 shooting death of Gordon, 45, at the Bremerton apartment the two shared.Sloan said the state will evaluate Phillips every 60 days. If he's found competent he can be recharged and tried, Sloan said, adding That will never happen. He's just too far gone.He's being put away for life. Whether he goes to trial or not, he's still behind bars, said Sloan. Western State is not a country club, he's in a room and the doors are locked, there's a barbed wire fence outside.Phillips allegedly shot Gordon in the head with a .38-caliber revolver as she lay in bed after a discussion Nov. 14 at the Canyon Park Apartments.Gordon's 15-year-old son, who has Down Syndrome, was in the apartment at the time, but was unharmed.
